1. EQ Perks Program

a. Only natural persons resident in Australia can be EQ Perks members. Program membership cannot be held jointly.

b. We may refuse any application for membership in its sole and absolute discretion.

c. By completing an enrolment form, by providing verbal consent to participate in the Program as a EQ Perks Member; or by claiming a benefit or reward under the Program, a person will be taken to accept these Terms and Conditions (as amended from time to time) and agree to be bound by them.

d. EQ Saddlery (or agents acting on its behalf) collects personal information from EQ Perks Members to administer the Program, to properly account for accrued points and other benefits, and for direct marketing. If personal information is not provided, customers may not receive all of the benefits and rewards of the Program (and, in some cases, customers may not be eligible to participate in the Program). Personal information may be provided to delivery service providers, manufacturers, suppliers, distributors, marketing and communications agencies, data analysts and IT services providers. The EQ Perks Program Privacy Policy includes information about how an EQ Perks Member may access and correct his or her personal information or make a complaint about privacy.

e. By completing an enrolment form or providing verbal consent to participate in the Program as a EQ Perks Member, a person consents to EQ Saddlery (and its agents and contractors) using and disclosing their personal information for the purposes of direct marketing of goods and services. Direct marketing communications may be made by email, SMS, push notifications, social media, or by regular post. An EQ Perks Member may “opt out” of direct marketing communications at any time by contacting EQ Saddlery on 03 8080 1336 or by emailing eqperks@eqsaddlery.com.au.

f. EQ Perk points are earned on any purchase through our Website, whether supplied by EQ Saddlery or from a Seller via EQ Marketplace.

g. Points are not transferable and have no cash or monetary value.

h. Points are calculated on the purchase price of qualifying purchases (inclusive of GST) rounded down to the nearest dollar.

i. Points automatically expire after 365 days (12 months).

j. There are 4 tiers in the Program: ‘Bronze’, ‘Silver’, ‘Gold’ and ‘Platinum’. EQ Perks Members are eligible to move up, and required to move down, tiers based on their qualifying purchases (in accordance with the table below). All EQ Perks Members regardless of tier will receive 1 point for every dollar spent on qualifying products or services. Points cannot be claimed retrospectively.

k. When an EQ Perks Member obtains a refund or reimbursement for charges previously incurred (for example, for returned goods or services), the points previously accrued for that purchase will be reversed and/or cancelled.

l. We may adjust an EQ Perks Member’s points balance in the event of an incorrect accrual (whether due to EQ Saddlery’s error or otherwise).

m. When an EQ Perks Member accumulates 500 points, the EQ Perks Member will receive a store credit to the value of $10.00 (“Perks Voucher(s)”).

n. Perks Vouchers expire after a period of 60 days from the date upon which the Perks Voucher was issued. Perks Vouchers are redeemable for qualifying products and services at EQ Saddlery retail stores.

o. Perks Vouchers may only be redeemed by the EQ Perks Member personally. Perks Vouchers are not transferrable and are not redeemable for cash.

p. We may make other benefits and rewards available to EQ Perks Members from time to time (whether generally or specifically to particular Program tiers). The benefits and rewards available to EQ Perks Members from time to time will be specified on the EQ Perks website. Such benefits and rewards may be withdrawn, amended or substituted from time to time in our discretion. Unless otherwise specified, benefits and rewards are not transferable and are not redeemable for cash. Benefits and rewards cannot be used in conjunction with any other offer or at the same time as other benefits in the program.

q. EQ Perks Members may also be given the opportunity to receive offers, special discounts and enter into competitions (“Offers”). Offers are subject to further terms and conditions, the details of which will be available at the time of each Offer. Offers may be communicated by email, SMS, push notifications, social media, or regular post.

r. Discounts made available for EQ Perks Members from time-to-time apply only to full-priced items sold by EQ Saddlery and are not available in conjunction with any other offer, unless otherwise specified.

s. An EQ Perks Member may cancel his or her membership at any time by written notice to us. In the event of cancellation, all accrued points, Loyalty Vouchers, and other benefits and rewards will be automatically cancelled and forfeited.

t. Any failure by an EQ Perks Member to adhere to these terms may result in termination of their membership in the Program and the automatic cancellation and forfeiture of accrued points, Loyalty Dollars, and other benefits and rewards.

u. We may terminate the Program at any time. In the event of termination of the Program, we will notify EQ Perks Members of the termination of the Program. All accrued vouchers, and other benefits and rewards must be redeemed within 8 weeks of the date of termination. All accrued points, vouchers and other benefits and rewards which are not redeemed will be forfeited.

v. We will use reasonable endeavours to transmit notices relevant to the administration of the Program to each EQ Perks Member in accordance with his or her communication preferences. Any notice will be deemed to have been given if posted to the mailing address or emailed to email address last notified by the EQ Perks Member. Each EQ Perks Member is responsible for advising EQ Saddlery of any change to their contact details or communications preferences. We are not liable for an accidental failure to deliver (or the non-receipt of) a notice.

w. We will not be liable for any disruption to the Program or any delay in providing, or inability to provide, any of the benefits of the Program which is caused by circumstances beyond the control of EQ Saddlery (including but not limited to strikes or industrial disputes, pandemics, acts of God, flood, weather, aircraft unserviceability or unavailability, war or civil disturbance).

x. Any questions regarding the Program may be referred to the store manager of a participating EQ Saddlery store. Questions may also be directed via eqperks@eqsaddlery.com.au

y. Any dispute regarding eligibility to participate in the Program; accrual or redemption of points; eligibility for any benefit or reward; or any other dispute which arises in connection with a EQ Perks Member’s participation in the Program will be determined by EQ Saddlery in its sole and absolute discretion.

z. To the fullest extent permissible by law, we will not be liable for any loss suffered by an EQ Perks Member arising in connection with their membership in the EQ Perks Program. Nothing in these Terms and Conditions is to be read as excluding, restricting or modifying the application of any legislation which by law cannot be excluded, restricted or modified or limiting the rights of any person under the Australian Consumer Law.

aa. These Terms and Conditions may be changed, amended or varied at any time by EQ Saddlery without giving a reason by giving notice to EQ Perks Members. Without limiting any other means of giving notice, EQ Saddlery may give notice of an amendment to these terms and conditions by publishing a notice on the EQ Perks webpage.

2. EQ PERK, EQ Community Vouchers and Online Coupons

a. EQ Perk members will receive a voucher for their birthday and each time they spend $500.

b. These vouchers will be applied to member’s online account to redeem instore.

c. Vouchers and coupons cannot be redeemed on Saddles, Farrier Products, Vetlines, Supplements, Feed, Gift Cards or Sale items.

d. Vouchers are valid for 60 days from when they are applied.

e. Vouchers are not transferrable for cash.

f. In store vouchers can be exchanged for a coupon to use online if a member cannot access a store – members must request their vouchers be changed to a coupon.

g. The same exclusions and expiry for instore vouchers apply to online coupons.

3. Price Match Guarantee

a. We guarantee to match the price (including freight) of any current, identical, in stock item (“Comparison Item”) found in any Australian retailer’s physical or online store (“Price Match Guarantee”) subject to the terms and conditions set out herein.

b. The Price Match Guarantee does not apply to EQ Marketplace – it only applies for EQ Saddlery website or in-store retail purchases.

c. Our Price Match Guarantee includes Comparison Items you find online with a like for like retailer, provided that the item is identical and in stock.

d. When assessing the Price Match Guarantee from online stores we also consider the added cost of delivery to your location (if any). So, we consider whether the Comparison Product can be purchased and delivered to your location via an online store for a total price lower than the one we are offering.

e. Simply present the retailer’s current advertisement to one of our team members instore for verification with a copy or a link to the website offering the identical product at the lower price.

f. You must be an EQ Perks member in order to access the Price Match Guarantee.

g. Comparison Products must be identical including brand, model, colour and in stock and available for immediate purchase/delivery.

h. Stock clearances and liquidations (e.g. retailer clearance products or goods sold during receivership or external administration) are excluded from the Price Match Guarantee.

i. The Price Match Guarantee cannot be used in conjunction with any other offer, promotion or discount including VIP cards.

j. The comparison product must be an Australian-based retailer or Australian-based website selling direct to the public and shipped from within Australia.

k. When price matching, we assess the retailer’s final price inclusive of delivery, taxes, fees and charges against our price inclusive of delivery, taxes, fees and charges.

l. We reserve the right to limit the price match offer to one item per customer.

4. 10% off first order from EQ Saddlery – sign up offer on website

a. New customers who have not purchased with us online previously are eligible for 10% off their first online purchase with EQ Saddlery (not EQ Marketplace) subject to the terms and conditions set out herein.

b. This offer is not available on saddles, hoof-care, feed or vet products or any sale items or in conjunction with any other offer.

c. This offer is valid once-only per person to customers with delivery addresses in Australia only.

d. EQ Saddlery reserves the right to end this offer at any time.

5. EQ Saddlery Gift Cards

a. EQ Saddlery gift cards (“gift cards”) are available for purchase instore and online (including on EQ Marketplace).

b. Gift cards can be redeemed instore and online.

c. Gift cards are not redeemable for cash and cannot be redeemed against a prior purchase.

d. Gift cards are not redeemable in conjunction with any other offer.
